The Clerk of Superior Court is elected by the voters for four-year terms. The Clerk of Superior Court is established in the Constitution of the State of Georgia. The Clerk's duties are statutory in nature & are found in the Official Code of Georgia in literally hundreds of statutes created by the state legislature. The Clerk & Deputy Clerks are custodians over the land & property records of the county as well as the civil & criminal files & records in the courts served.
General duties & responsibilities include: Deed & Property Recording Transfer; Transfer Tax & Intangible Tax Collection; Plat/Survey Recording; Military Discharge Recording; Trade Name Registration; UCC Recording; Lien Recording; Notary Public Certificates; Civil & Domestic Court Filing & Processing; Garnishment Filing & Management; Adoption Filing & Processing; Criminal Court Filing & Processing; Accountability Court Filing & Processing; Court Registry Management; Fine & Fee Collection & Disbursement; Child Support Receiver; Board of Equalization; Jury Management; Acceptance Agent for Passport Applications.

Magistrate Court
The Magistrate Court of Ware County supports the County's mission by providing for its citizens fairness and efficiency by adjudicating all cases in a courteous and impartial forum utilizing the uniform and coherent applications of the United States Constitution, Laws of the State of Georgia and the ordinances set forth by Ware County. The mission of the Magistrate Court is to deliver justice to the citizens of Ware County by ruling on disputed claims or approving mutual settlements in civil cases as well as serving as the court of entry into the criminal justice system.

The Chief Clerk is the office manager and handles all general office duties. Part-Time Magistrate Judges are on call after office hours from Monday until Sunday every other week and hold Bonds Hearings the Saturday that they are on call.
